Bail Hearings

Per the Criminal Code of Canada, you have the right to a bail hearing within 24 hours of being arrested if a judge is available, or as soon as possible.

The decision to grant bail is made by a judge or justice of the peace at a bail hearing.

The Charter of Rights and Freedoms recognizes reasonable bail as a constitutional right.

A lawyer will help the accused by representing them and proposing an acceptable bail plan, so that individual can be released back into the community, awaiting a resolution or trial.
