Weapons
Section 2 of the Criminal Code of Canada defines a weapon as “anything used, designed to be used or intended for use (a) in causing death or injury to any person, or (b) for the purpose of threatening or intimidating any person”.
This includes but is not limited to firearms, knives, objects and/or anything used or designed to be used in binding or tying up a person against their will.
Per section 96, possessing a weapon for a dangerous purpose carries a maximum penalty of 10 years imprisonment on indictment.
Per section 267, assault with a weapon occurs when committing an assault, the person carries, uses, or threatens to use a weapon (or an imitation of one), is guilty of an indictable offence. The maximum penalty for this offence is 10 years imprisonment.
